Dear Prospective Client,
I am committed to our success, so if you feel there is some part of the coaching relationship that isn’t working, please say so. I promise to do whatever is necessary to resolve the issue. I will appreciate, respect and value your honesty.
You may text, email, or call me between our meetings if you need support, have a challenge, or can’t wait to share a success with me. I do have time between our regular meetings to speak with you. I enjoy providing this extra level of service. I do not bill for additional time of this type, but I ask that you please keep the extra calls to five or 10 minutes at a time.
COACHING AGREEMENT
This Agreement is between: Kirin Parmar, Transformation Life Coach and Enneagram Consultant, 159 Middlefield Drive, San Francisco, CA 94132 (Coach), and yourself (Client) whereby Coach agrees to provide Coaching Services for Client.
Description: Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and Client in a thought-provoking and creative process that inspires the client to maximize personal, professional or business potential.
GROUND RULES
· Client is responsible for being on time
· Client pays coaching fees in advance
· Client pays for long-distance phone charges if any
· Online, Emailed or Faxed signed Agreements are considered legally binding
Schedule and Fees: This coaching agreement is valid as of the date of purchase recorded on your invoice/receipt. Our agreed upon fee is either the pay-in-full price (10% savings over an installment plan option) or the sum total under the installment plan option, that you confirm by clicking on BUY. All payments are in advance of your sessions. Sessions will be at the rate of three a month, typically over the first three weeks of a month. Your last week is to be used to integrate your learning to-date. A session lasts for an average of 50 minutes but varies from 40 to 60 minutes as needed. Your Coach charges by results, not time, and is deeply committed to being of best service to you. She also works for you outside of session time composing or organizing learning materials and tools relevant to your customized needs. The package provides for 5-10 minutes in-between calls for just-in-time help.
Please ensure that timely payments are made; if on the monthly installment plan and payments are consistently late, you will be asked to find another coach.
Opt-Out Clause: Provided you give it your full-effort by attending the first three sessions within 30 days and complete all agreed-upon assignments, if at the end of this period, coaching is not for you, you have a one-time opportunity to opt-out of the contract. Any prepaid funds pro-rated to future sessions will be refunded to you. These three sessions I refer to do not include the two enneagram typing interview sessions conducted ahead of this 30-day period, the cost of which is refunded to clients who stay with the full program.
Procedure: Your sessions will be by zoom or by phone, as mutually agreed in advance. For sessions by zoom, your coach will send you a link. For sessions by phone, you are responsible for calling your coach at the number she will give you. The time of the Coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time. If the Coach will be at any other number for a scheduled call, Client will be notified prior to the scheduled appointment time.

Changes and cancellation policy: Client agrees that it is Client’s responsibility to notify the Coach at least 24 hours in advance of the scheduled calls/meetings. Your coach does not owe you for missed time due to your starting late. Coach reserves the right to bill Client for a missed meeting. Coach will attempt in good faith to reschedule the meeting. Similarly, if Coach has to cancel, Client will attempt in good faith to reschedule, failing which, Client will be refunded for that session. Reschedules are to be made during the same month unless there are special circumstances which the Coach has the right to choose to accept. If Client or Coach wants to be on vacation or holiday, we can make up the time. Your Coach will allow for an extension for up to one month for a six-month package, or more or less time pro-rated to your package length, with adequate notice on a case-by-case basis. Two weeks minimum is required for vacation plans.
Responsibilities:
· Coach agrees to maintain the ethics and standards of the behavior set forth by the International Coaching Federation (“ICF”). For more information, refer to: www.coachfederation.ord/ethics.
· Client agrees that the Coach is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client is responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results.
· Client understands coaching does not involve the diagnoses or treatment of mental disorders as diagnosed by the American Psychiatric Association. Coaching is not, and Client will not use it as, a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment or any other form of therapy. Coaching does not prevent, cure, or treat any mental disorder or medical disease.
· If Client is currently in therapy or otherwise under the care of a mental health professional, client promises to have first consulted with the mental health provider regarding the advisability of working with a coach and that this person is aware of Client’s decision to proceed with the coaching relationship.
· Client understands that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual, mental or other qualified professionals and will seek independent professional guidance for such matters.
· Client understands coaching is a comprehensive process that may involve all areas of Client’s life, including work, finances, health, relationships, education and recreation. Client acknowledges that deciding how to handle these issues, incorporate coaching into those areas, and implement choices is exclusively his/her sole responsibility.
· Client agrees to communicate honestly, be open to feedback and assistance and create the time and energy to participate fully in the program.
Confidentiality: This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (like in Medicine or Law). The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information or (e) that the Coach is required by law to disclose. If Client reports child, elder abuse or neglect or threatens to harm self or someone else, Client understands that all necessary actions will be taken and Client’s confidentiality agreement is limited in this capacity.
Use of technology: Client understands that the use of technology is not always secure, and Client accepts the risks of confidentiality in the use of email, text, phone, Zoom and other technology.
Release of Information: The Coach engages in continuing education pursuing ICF (International Coaching Federation) and other Credentials. The process sometimes requires the names and contact information of all Clients for possible verification. By agreeing to the terms of this agreement, you agree to have only your name, contact information and start and end dates of coaching shared with ICF and/or other parties involved in this process for the sole purpose of verifying the coaching relationship. No personal notes will be shared.
According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, furthering coach professional development and/or consultation purposes.
Termination: The term of this relationship is based on the package you are choosing. For continuing clients in a month-to-month basis, cancellation is effective with 14 days of notice. In the event of fees owed at the time of cancellation, full payment is due and payable within one week of cancellation of service.
Liability: Except as expressly provided in this agreement, the Coach makes no guarantees or warranties, express or implied. To the extent that our work together includes career or business, the Coach is not promising outcomes included but not limited to increased clientele, profitability and/or business success. In no event shall the Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, The Coach’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Coach under this agreement for all services rendered up until the termination date.
This is the entire agreement of the parties and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written and oral representations.
If a dispute arises out of this agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice is given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party. This agreement shall bind Client’s heirs, executors, personal representatives, successors, assigns and agents.
Law: Client understands that coaching is, at present, an unregulated industry and that your Coach is not licensed by the State of California or any other state. You also understand that for all legal purposes, this Agreement and the rights of the parties hereunder shall be governed and interpreted in accordance with the laws of the State of California.
